Colorado Passed an AI Bias Law. The FTC Just Said That Might Be Illegal.
The FTC voted 2-0 to propose that Colorado's AI Act is impliedly preempted by federal law, arguing the state's anti-bias rules could itself violate consumer protection law. The theory has never been tested in court.
